À l'encontre de toute possibilité de formuler des réserves à une disposition indérogeable, on a fait valoir que, dès lors que toute suspension des obligations en question sont exclues par le traité, « with greater reason one should not admit any reservations, perpetuated in time until withdrawn by the State at issue; such reservations are (…) without any caveat, incompatible with the object and purpose of those treaties » [à plus forte raison, on ne devrait pas admettre quelque réserve que ce soit sans limitation de durée jusqu'à son retrait par l'État en question; de telles réserves sont, sans restriction aucune, contraires à l'objet et au but de tels traités].وفي مواجهة كل احتمال إبداء تحفظات على حكم لا يجوز الحيد عنه، حوجج عندها بأن كل تعليق للالتزامات المعنية مستبعد بمقتضى المعاهدة، ''فثمة سبب راجح يدفع المرء إلى عدم قبول أي تحفظات مؤبدة إلى أن تسحبها الدولة المعنية؛ فهذه التحفظات تتنافى، دون أي قيد كان، مع غرض تلك المعاهدات ومقصدها``.
